Terms of Service

1. Agreement to Terms

By accessing or using the Kinship platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a church or organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Kinship is a church management platform that provides tools for member management, communication (email and SMS), event management, online giving, volunteer scheduling, group management, and related features.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age.

4. Subscription and Billing

The Service offers free and paid subscription plans. Paid plans are billed monthly or annually. All fees are in U.S. dollars and non-refundable except as required by law.

  • • Free Plan: Up to 50 active members with all core features.
  • • Paid Plans: Based on active member count. Upgrade or downgrade at any time.
  • • SMS Credits: Pay-as-you-go at cost, purchased through your wallet.

We reserve the right to change pricing with 30 days' notice.

5. Your Data

You retain all rights to data you upload or create ("Your Data"). We store and process Your Data solely to provide the Service. You may export Your Data at any time. Upon termination, data is retained for 90 days then permanently deleted.

6. Acceptable Use

You agree not to:

  • •Use the Service for unlawful purposes
  • •Send unsolicited bulk messages (spam)
  • •Upload malicious code or compromise Service security
  • •Reverse-engineer or decompile any part of the Service
  • •Resell or sublicense the Service without consent

7. Communications Compliance

When using email and SMS features, you agree to comply with CAN-SPAM, TCPA, and all applicable regulations. You must obtain proper consent before sending communications. We may suspend privileges if violations are detected.

8. Online Giving

Donations are processed through Stripe. Churches may process donations through Kinship's payment platform or connect their own Stripe account. By using giving features, you agree to Stripe's terms of service. Kinship does not charge additional processing fees beyond what Stripe charges.

9. Service Availability

We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kinship SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount paid in the twelve months preceding the claim.

11. Termination

You may terminate your account at any time. We may suspend access for Terms violations. Data is retained 90 days post-termination, then permanently deleted.

12. Changes to Terms

We may update these Terms with 30 days' notice via email. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of such courts.
